Terms of Service for Away Wanderlust

Welcome to Away Wanderlust (“we,” “us,” or “our”). By accessing or using our website (www.awaywanderlust.com) and services, you agree to comply with and be bound by these Terms of Service (“TOS”). If you disagree, please refrain from using our website.


1. Governing Law

This agreement is governed by Indonesian law, including:

  • Law No. 8 of 1999 on Consumer Protection
  • Law No. 11 of 2008 on Electronic Information and Transactions (as amended)
  • Government Regulation No. 71 of 2019 on Electronic Systems and Transactions

Disputes will be resolved through Indonesian courts or alternative mechanisms under Indonesian law.


2. Use of Services

You agree to:

  • Provide accurate information when required.
  • Use the website lawfully and refrain from harmful activities (e.g., spreading prohibited content under UU ITE).
  • Your use of our services is also governed by our Privacy Policy, which can be accessed at our Privacy Policy page.

3. Intellectual Property

All content (text, images, logos) is owned by or licensed to us. Unauthorized reproduction or distribution is prohibited.


4. Payments & Currency

  • All transactions are in Indonesian Rupiah (IDR).
  • Prices include applicable taxes (e.g., VAT).
  • Refunds follow Indonesian Consumer Protection Law and our stated policies.

5. Consumer Rights

Under Indonesian Consumer Protection Law (UU No. 8/1999), you have the right to:

  • Accurate Information: Receive clear details about products/services (pricing, features, terms).
  • Cancellation & Refunds: Cancel orders within 7 days of purchase (if services are not yet rendered) and request refunds for defective or undelivered products.
  • Product Quality: Receive goods/services as advertised and in proper condition.
  • Fair Treatment: Protection from fraudulent or unfair business practices.

6. Dispute Resolution

Step 1: Informal Negotiation

  • Contact us first at [email protected] to resolve issues. We will respond within 30 days.

Step 2: Mediation (BPSK)

  • If unresolved, disputes may be escalated to the Indonesian Consumer Dispute Resolution Body (Badan Penyelesaian Sengketa Konsumen/BPSK).
  • Mediation through BPSK is free and must be initiated within 60 days of the dispute arising.

Step 3: Litigation

  • If mediation fails, disputes will be settled in Indonesian courts.

7. User-Generated Content

You grant us a non-exclusive license to use submitted content (reviews, comments, photos, videos etc). Ensure your content complies with Indonesian law (no defamation, hate speech, or illegal material).


8. Limitation of Liability

We are not liable for:

  • Indirect damages (e.g., loss of profits) from website use.
  • Third-party actions (e.g., payment processors, linked sites).

9. Termination

We may suspend or terminate access for violations of these TOS or Indonesian law.


10. Amendments

Updates to this TOS will be posted here. Continued use constitutes acceptance.
